The Computer-Adaptive Test for Reading Chinese (CATRC)

Agreement between the Developer and the User (Test Center)

1. Tao-chung Yao, Dept. of East Asian Languages and Literatures, University of Hawaii, (the developer), grants _______________________________________________________________________

(the user) the right to use the current prototype version of the Computer-Adaptive Test for Reading Chinese (CATRC) for the purpose of evaluating reading proficiency in Chinese. The user may install the test on one or more machines when the test is given, but will delete the test from all machines when the testing is done, for test security.

2. The user acknowledges that CATRC is protected under the copyright law. The user may not alter or modify the test (the computer programs and the test items) without written permission from the developer. The user may not reproduce the test, either in part or in its entirety, in any form, including, but not limited to printing out the test items or the computer programs, or taking pictures of the test items. Nor is the user allowed to reveal any of the test items to anybody in any way. In addition, it is the user's responsibility to guard the test against theft or misuse at all times. The user agrees that s/he will be present each time CATRC is used to ensure the security of CATRC, and will be responsible for any leaking of the test items. The user will be liable for the cost of preparing new test items to replace any leaked ones.

3. The developer provides CATRC as is, without any warranty or promise of technical support, and disclaims any liability of any kind for any damages whatsoever resulting from the use of CATRC.

4. The developer makes no warranties, expressed or implied, with respect to the program as to marketability or fitness for a particular purpose.

5. CATRC is provided to the user by the developer free of charge. In exchange for this privilege, the user agrees to record and inform the developer of any bugs in the computer program, and any mistakes in the test items. The user also agrees to share the test results with the developer by e-mailing them to <tyao@hawaii.edu.> after each administration of the test.
